Terms & Conditions and Refund Policy

1. Introduction
Welcome to No Nonsense Avalon, where we offer a variety of health and wellness Services including Group Classes, Injury Treatment, Massage Therapies, Personal Training, Pilates, Yoga, MovNat, and Red Light & Infrared Therapy. By using our Services, you agree to the following Terms and Conditions (T&Cs). Please read them carefully.

2. Services
2.1 Injury Treatment
Injury Treatment Services are provided by qualified professionals. These Services are designed to address injuries and may require multiple sessions.

2.2 Massage Therapies
Massage Therapies are performed by qualified massage therapists. Sessions are tailored to your individual needs and may include various techniques. Massages as part of a Membership or Pack are not eligible for health fund rebates.

2.3 Group Classes
Our Group Classes include, but are not limited to, Yoga, Pilates, MovNat, and various Fitness Classes. Fitness Classes may encompass a range of activities such as high-intensity interval training (HIIT), circuit training, strength training, and cardio-based workouts. Class schedules are subject to change based on availability and demand.

2.4 Personal Training
Personal Training Sessions are customised to help you achieve your fitness goals. A fitness assessment may be required before starting Sessions. Please inform us of any medical conditions or injuries before participating.

2.5 Pilates & Yoga
Our Pilates and Yoga Sessions are suitable for all levels. Please inform us of any medical conditions or injuries before participating.

2.6 MovNat
MovNat Classes focus on natural movement skills. Participants should be in good health and able to engage in physical activity.

2.7 Red Light & Infrared Therapy
These Therapies are designed to promote wellness and recovery. Sessions may vary based on individual needs.

3. Memberships and Packs
3.1 Payment
Memberships are paid in advance of the agreed service payment cycle. The full amount for the service cycle term is required before redeeming against any services.

3.2 Early Termination
An early termination fee of $250 will apply, or the remainder of the contract amount, whichever is smaller. In the case of casual contracts, there is no termination fee. 

3.3 Membership Pause
Placing all Memberships on pause incurs an administration fee of:

  • $5 per week for Classes

  • $30 per week for Personal Training or Pilates Memberships

  • $10 per week for all other Memberships

Pauses in Memberships can be requested at any time. However, all Memberships are liable for the pause fees outlined above.


3.4 10-Pack Expiration and Reactivation
10-packs of Services expire 3 months from the date of purchase. Reactivation of an expired 10-pack incurs a $25 administration fee.

3.5 Unlimited Services Limits
Unlimited Classes: Allows a maximum of 7 Classes per week.
Unlimited Red Light & Infrared Therapy: Allows a maximum of 3 Sessions per week.

3.6 Discounts
No additional discounts apply to Sessions included in a Membership or Services purchased as part of a special offer.

3.7 Membership Changes and Cancellations
All changes to Memberships must be submitted in writing. Any cancellation of a Membership must be done in writing at least 4 weeks in advance of the desired cancellation date.

4. Booking and Cancellation
4.1 Booking
All Services must be booked in advance. Bookings can be made online, by phone, or in person.

4.2 Group Class Cancellation Policy
Cancellations for Group Classes require a minimum of 8 hours’ notice. Cancellations made with less than 8 hours’ notice will incur a fee equal to the Class cost.

4.3 Injury Treatment, Massage Therapies, Personal Training, Pilates, Yoga, MovNat
We require a minimum of 24 hours’ notice for cancellations. Cancellations made with less than 24 hours’ notice will incur a fee equal to 100% of the appointment cost.

4.4 No-Shows
Failure to attend a scheduled Session without prior notice will result in a charge of 100% of the Service fee.

5. Punctuality
5.1 Arrival Time
Please arrive at least 5 minutes before your scheduled Session or Class. This allows time for check-in, preparation, and ensures that the Session can start on time.

5.2 Late Arrival
If you arrive late, your Session may be shortened to avoid interfering with other scheduled appointments. Full payment is required for the booked service, regardless of late arrival.

6. Payments and Refunds
6.1 Payments
Group Classes: Must be paid for at the time of booking.
Injury Treatment, Massage Therapies, Personal Training, Pilates, Yoga, MovNat, Red Light & Infrared Therapy: Payments must be made at the end of the Session. We accept various forms of payment including credit/debit cards and cash.

 

6.2 Surcharges

All payments made to No Nonsense are subject to a surcharge that varies depending on the payment method used. This surcharge is a pass-through cost intended solely to cover the processing fees incurred by No Nonsense. No Nonsense does not benefit financially from this surcharge; it is strictly to cover the costs associated with payment processing.

6.3 Refunds
Refunds are not provided for Services rendered. In cases where prepaid Services are not provided due to our fault, a full refund or credit will be issued.

7. Gift Cards
Gift Cards are available for purchase and can be used toward any of our Services. They are valid for 12 months from the date of purchase. Gift Cards are non-refundable and cannot be exchanged for cash. Lost or stolen Gift Cards will not be replaced.

 

7.1 Gift Card Responsibility

You are solely responsible for the safekeeping of your Gift Card. No Nonsense Avalon will not always be able to track or manage Gift Card balances or numbers.

 

7.2 Value and Pricing

Gift Cards are purchased at a specified value. If Service prices change, you are responsible for covering any additional cost beyond the Gift Card value at the time of redemption. Gift Cards may be partially redeemed, however, this does not change the original expiration date.

7.3 Redeeming a Gift Card

The Gift Card number must be presented when booking the Session or at the end of the Session. Failure to present the Card Number means you are responsible for payment by alternate methods.


8. Health and Safety
8.1 Health Disclosure
It is your responsibility to disclose any medical conditions, injuries, or other relevant information that might affect your participation in our Services. Any changes to your health status must be submitted to No Nonsense Avalon in writing.

8.2 Liability Waiver
By participating in our Services, you acknowledge and accept the risks associated with physical activities. You agree to release No Nonsense Avalon and its staff from any liability for injuries or damages resulting from your participation.

9. Staff Qualifications
9.1 Qualifications
All staff and contractors at No Nonsense Avalon are required to hold relevant qualifications, certifications, and insurances for their roles.

9.2 Credential Verification
We verify credentials before engagement and maintain current records, available for review upon request.

9.3 Compliance
We ensure ongoing compliance with industry standards and require staff and contractors to complete continuing education as needed.

9.4 Liability
While we ensure qualified personnel, we do not guarantee specific outcomes and are not liable for claims related to staff performance beyond legal requirements.

9.5 Updates
We may update our qualification policies and will inform clients of significant changes affecting services.

10. Code of Conduct
10.1 Behaviour
We expect all clients to conduct themselves respectfully towards staff and other clients. Disruptive or inappropriate behaviour may result in termination of Services.

10.2 Personal Belongings
No Nonsense Avalon is not responsible for the loss or damage of personal belongings.

11. Refusal of Service
11.1 Right to Refuse Service
No Nonsense Avalon reserves the right to refuse Service to any client at our discretion. Reasons for refusal may include, but are not limited to, violation of our T&Cs, inappropriate behaviour, or health and safety concerns.

12. Privacy Policy
12.1 Data Collection
We collect personal information necessary for providing Services. This information is used in accordance with our Privacy Policy and will not be shared with third parties without your consent.

12.2 Data Security
We implement appropriate measures to protect your personal information from unauthorised access or disclosure.


13. Amendments to Terms
13.1 Changes
We reserve the right to modify these T&Cs at any time. Changes will be posted on our website, and continued use of our Services constitutes acceptance of the updated terms.
